I work the graveyard 12 hour shifts 6pm to 6:30am,
I get home around 8 a.m In the morning,
I sleep 9am to 4:30pm my neighbor on my bedroom side has been doing construction for over the last 4 weeks 8 am to 4pm, the property owner next door came to my door and told me 4 weeks ago there was only going to be a brick wall 6 feet high and 7 feet long and if they could lay part of the Foundation on my property to better support the wall, i said yes and informed her i sleep days and it was only a small wall I could deal with that, now they're doing extra work hammering and digging and Mixing cement,
I use sleeping aids and a white noise machine at full volume I am exhausted at work
I have had difficulty talking to these people in the past about the noise is there any legal action I can take.
You gave permission for the work to be done. All construction work takes place during the day, not at night. I do not see any basis for legal action on your part. Unfortunately, your work and sleep schedule are different than those of most people.
Based upon your comments, I do not see any basis for an action against your neighbor. Although I am doubtful that you have any recourse, you can certainly investigate as to whether any local ordinances are applicable that might pertain to work schedules, noise, nuisance. If you think that is the case, you can consult with a local attorney whose practice is concentrated in construction law and perhaps municipal law.
Unfortunately, your sleep schedule differs from that of most people. People are allowed to perform construction work on their property, even without the permission of neighbors. In San Francisco, construction is allowed 7 days per week between the hours of 7 am and 7 pm. As long as they are doing the work within those hours, there is probably nothing that you can do. If the work requires a permit and they did not get one, a report to the city might stop the work, but only for a little while; it would eventually start up again. A friend of mine uses earplugs when she sleeps, maybe you can try those.
