Can an individual sue tobacco companies for wrongful death related to smoking?

Business 7 views 3 answers
My wife died June 2nd 2014 at age 65. We both started smoking in our teens when cartoon characters were used by tobacco companies to encourage kids to start smoking. I have medical proof that her health issues leading up to her death was caused by years of smoking. We both tried many times to quit, but failed until about 5 years prior to her death. I was then forced to refuse to buy any more cigarettes.

There have been some successful claims, but I think you may have a problem with the statute of limitations, or statute of repose, at this point. You should consult with a lawyer in your area to determine what rights you have to bring a claim, and what the time limitations on such claims would be. has a very helpful find a lawyer tool. Good luck.

Look for a member of the Arkansas Trial Lawyers Assn/Assn for Justice that handles product liability cases. See who they suggest.
