You have previously asked this question. Your mother needs to file an eviction, ejectment, or unlawful detainer action depending on the factual analysis. I am going to tag this question in the real estate area of as these are specific to real estate.

Each action - eviction, ejectment, or unlawful detainer - have specific requirements. That's why you should speak with a local attorney who handles landlord-tenant cases ASAP.

Your mother should file a lawsuit for removal of your sister. Your mother should start by writing a letter to your sister telling her to move out immediately and that she will file a lawsuit for removal of your sister if your sister does not move out immediately. I believe that the correct lawsuit is unlawful detainer, but your mother should make an appointment with a local lawyer to go over the facts just to be sure. When an owner wants a house guest removed, it usually is unlawful detainer, which is a very close lawsuit to eviction. However, if the owner files an eviction and it should have been an unlawful detainer, the judge can dismiss the lawsuit. So, definitely encourage your mom to see a real estate lawyer or eviction attorney today. Good luck!

She can file an ejectment action, she can call the police and report the theft, she can lay down some rules and tell your sister that she is required to move out if she doesn't follow them - rules like get a job, pay rent, do chores, contribute to the household, go to family counseling, etc. Once she has the baby, if she is not supporting the baby and caring for the baby, your mom can call DCF and report her for abuse or neglect - in other words your mom can impose consequences for her bad behavior that will make her choose to leave the home. It is possible that your sister has just never been right, or it is possible that your mom has never really followed through with consequences on a consistent basis and this is why your sister behaves this way.

You can evict the person from the house just like anyone else. It doesn't have to be someone paying rent to get them out of the house. You should go see a lawyer.
