Did you receive a notice of discontinuance? Sometimes mortgagees voluntarily discontinue actions and it could be that it occurred in your case. Chase may be able to recommence the action if would still be timely to do so (within the statute of limitations) and assuming the matter was not discontinued with prejudice (which is unlikely). You can certainly speak to foreclosure defense counsel and confirm that the action was in fact discontinued. It is also possible that Chase sold the loan to another entity. Best of luck, Barbie D. If the lender discontinued its action this means that they are requesting that the court remove the matter from their docket & cancel the lis pendens filed against the property. So, the lender wishes to end the pending foreclosure action against you. However, in no way does this necessarily mean the matter is over. Typically, the lender will discontinue the action either if the outstanding debt on the mortgage is resolved (whether through loan modification, reinstatement, short sale, deed-in-lieu of foreclosure, etc.) or if they need to restart the action. If you have not resolved the outstanding debt in any way, then in most likelihood, the lender is planning to restart the action because something was done improperly over the course (or in preparation for) of the action, such as failure to send proper default notices before instituting the action or failure to properly verify affidavits which were used to obtain a judgment. If you have not resolved the mortgage debt, you should continue to communicate with the lender & try to resolve your default or you will most likely be served with papers and have a new action filed against you.

Normally it means that the plaintiff (Chase) dropped the case. It can be with or without prejudice. I suggest that you get a copy of the filing from the court file.
