Father is incarcerated, and mother is indifferent as to him going back with her she has 3 other kids all older and the oldest 17 but she doesn't seem to have any interest in having him back from what she tells me

Bless you for taking in this child and caring enough to want legal custody. If you have no money, call Houston Volunteer Lawyers at 713-228-0732. There are also free forms on www.texaslawhelp.org - confusing but they are approved by the Supreme Court of Texas. Look on this website for an attorney to help you. We are NOT allowed to make referrals. God bless you!

Hire an attorney to file suit to have you appointed CP of the child. You should be able to get some form of support from the parents.

Consult/hire a local family law attorney to see about filing suit to formally establish rights for you and obligations (such as support) against the biological parents.

You need to contact a family law attorney in your area to discuss filing a Petition seeking conservatorship or legal custody of your nephew. As someone who has had care and control of him for over 6 months you should have standing to file with the Court. Without a Court order bio mom could come and demand possession of him at any time.
