Is it too late to sue Paxil for malpractice?

Business 5 views 2 answers
I WAS prescribed paxil in 2004 for anxiety and decided to quit in 2005 when I became pregnant with my daughter which sent me into a downward spiral, I litterally went crazy and spiriled out of control, the withdrawls were terrible and the mental health issues were worse, I attempted suicide, became violent etc...and even after the birth of my daughter found myself self medicating to cope, I got sober in late 2008, I wasn't aware of the side effects of Paxil until recently and was wondering if I can still sue the company?

I'm sorry but unless there are extenuating circumstances or there is a VERY liberal statute of limitations in SD, you are likely barred by the statute of limitations from further proceeding. You should google: "paxil class action" to see if one is going that you can join or alternatively "paxil lawyer". It's hard to say whether you want to bring a claim for malpractice against whomever prescribed it vs a claim against Paxil's manufacturer for product liabilty but a SD medical malpractice lawyer, and most give an free first visit can further explore and tell you your options. good luck
