I lived in New York. I need to get my husband to move from my apartment. Do I have to wait for the divorce to be final? How can I get him out because he doesn't want to move out of my apartment. Need your advice

Could take 8-12 months from the filing date to get your uncontested divorce finalized. To get your husband to leave, a judge will have to order him to leave or he will have to leave freely on his own.

You are not going to be able to get him out unless he agrees to go or a Judge decides the issue. I suggest that you consult with a matrimonial lawyer.

In Queens, uncontested divorces can take up to eighteen months to be signed by the court. This is not related to your other question of ejecting your spouse. The judgment must contain a provision granting you exclusive use and occupancy of the premises with a date for him to leave. Without this, you'll have to paint a white line down the middle of your apartment and split each others' possessions and keep to your side of the line.

Unfortunately, if he doesn't want to move out, it may not be an "uncontested" divorce. You should speak with an attorney directly to discuss your situation in confidential detail and be advised accordingly. Good luck!
