A cpl of my vacation days due to very bad roads due to the icy weather and family emergency the following wk. When I called again to remind them about my vacation days they told me I was a no call no show for 3 days n said that meant I quit. Yet the next wk I got my pay for 40 hrs vacation and ao day. This happens to be a multi million dollar cooperation that is getting ready for a massive layoff and word has it they have done this to several people already as well aside from those who has just chose to quit and go to another job before they got the same treatment.. do I have a case u think? I mean what company pays u out vacation pay and what not if u supposedly just quit on them??Sincerely, Alvin Renfroe Also, I have been with this company for 15 yrs...

Unfortunately, the question you post is a legal question that we can answer for you. I do not see anything unlawful in the facts that you provide. However, there may be other facts that are important to accessing whether your employer acted unlawfully. As such, you may want to consult with an experienced employment attorney if you want to pursue this matter. I recommend that you apply for unemployment benefits as soon as possible. As part of that process, you will be able to get a better idea of what the employer is saying. It might be that your request for vacation was not approved and, if so, you were expected to report for those three days. If the policy is that you must report for work or to call in each day, and you did not, then the employer may rely on its no call, no show policy.
