I paid for a divorce in Mexico, but it was never done. I re-married in CA and am now divorced again. Can I be legally punished?

I couldn't go to Mexico to handle my divorce in person, so I talked to an attorney on the phone and sent money. She said she could divorce my husband and I even though we both live in CA now. It was never done and I married again in CA. The CA marriage ended in divorce and I'm now worried about the marriage in Mexico. My first husband refuses to go to Mexico with me to get the divorce. We're now U.S. citizens. I own a house in CA and worry he'll fight my children for it when I pass. What kind of attorney do I need to find?

You should have the divorce (from 1st husband) done in CA. As long as you were legally married in Mexico (and I will assume that you were) you can get a divorce in CA if you meet their residency requirements. You should talk to a lawyer to make sure this gets done properly. In my experience (and I am not a CA attorney) the state prosecutors have better things to do that prosecute you for inadvertent bigamy. Based on your question, it sounds like a honest mistake that you did not make for fraudulent purposes. They might be able to charge you, but I would be very surprised. Also, how would they find out?

You need to speak with a Divorce Attorney in your area as quickly as possible. From the information you've presented, there may have been a host of problems with the first Divorce in Mexico -- jurisdiction, notice, etc. I would also contact the attorney in Mexico to obtain the COMPLETE file on the matter. It should contain all the paper work you need to determine if the Divorce was handled correctly and finalized in Mexico. You can use the Find a Lawyer option above to find an attorney in your area to discuss your options with. many offer free telephone consultations. I hope this response helped in some way. I wish you the best of luck.

You need an estate planning attorney. Then no one can take any part of.the house unless you leave it to them. Cleaning up the divorce is a good idea, but it is not the only way to take care of the house.
