Can my guests be restricted to my property due to the way the gate must be opened ( by cell phone only )

Bankruptcy and Debt 6 views 3 answers
I have a bar code but the HOA has rescinded all 4 digit codes to open gates. Now a visitor must dial a code which then dials my cell phone and I push 9 after answering to let them in. However, I have friends or relatives visiting and I am at work where I cannot answer my cell phone and normally do not have reception to even receive the call, thus my visitors can not get back into the community. Is this legal?

You will have to review the rules of the community carefully. The likely have a basis for this procedure for security purposes; and your benefit obviously to keep your home safe as well as others. They may have a procedure where you can let the office, or gate if it is manned, to let visitors through in advance.

There's no law that requires the HOA to let you guests into the community. Only your right to ingress and egress are protected by statute. Any way you can let your guests have your cell phone while they visit? Maybe you can come up with some other creative idea? How does FedEx, the post office, UPS and emergency responders enter? Talk to the board or the property manager to see if something can be worked out. I'm sure you're not the only homeowner with a problem with this.

More information would be needed to answer your question. For example, is there a manned entrance that your guests could enter through? Have you contacted the property manager to determine if there are other alternatives?
