I had a first offense Misdemeanor DUI in Houston Texas, Harris County in 2004. Still unable to get my license back.

I was sentenced to pay a fine, DUI school, community service, a years probation and an ignition interlock. I completed all my requirements except the interlock. I now live in California and have tried to get the interlock. But the laws between states make it next to impossible apparently. Do you think if I got my case before a judge, would he simply say. Here's your license back? I mean its been 11 years for a first offence misdemeanor. This is almost cruel and unusual punishment. I am a trained software engineer and while I can work from home (telecommute). The higher paying jobs are in Orange County or San Diego. I live near Temecula CA, (about 60 miles from those locations).

You need to contact Texas officials. It's not cruel and unusual, you admit you did not complete the interlock which means you were out of compliance with the terms of your case. It sounds like the case there is open and the court believes you are non compliant. Contact the TX court and see what they want or need to close the case and release this...

You need to hire a lawyer in Texas to have the DMV hold cleared by the Texas DMV, probably via the Texas court. If you got your TX DUI while on a CA driver's license, you'll have to take a CA DUI class. If the TX DUI was committed at a time when you didn't have a CA DL, the removal of the hold from TX should make you eligible to be licensed in CA.

Go to the DPS website and there is an eligibility requirement section. Put in your info and it will tell you what you need to do to get your license back.

Simple solution you need to hire a lawyer to file a motion to remove the interlock. Once granted it will be forwarded to DPS and you will not have to worry about it again
