Many more facts are needed about the incident, the allegation and whether your wife wishes to pursue the charges. You need to hire an experienced domestic violence lawyer who will fight to minimize the consequences of this incident for you. Domestic violence is extremely problematic for immigration purposes and a criminal conviction will cause you to lose your job. Hire an attorney ASAP.

It may be hard to get the Order of Protection modified while the case is pending unless the DA consents. More facts are needed. I suggest that you hire a good criminal defense lawyer.

I write extensively about how domestic violence is being managed by the politicians and the judiciary yet the same questions are always being asked. A reconciliation with the spouse is especially difficult in New York because of the empowerment the state gives the wife when there is a domestic violence charge involved. I had cases where the wife was coerced by hospital personnel to file false domestic violence allegations against innocent men under threat of losing their children to the child protective apparatus. So you do not know what the wife has been told by the state. All you know is that you must fully stay away and the prosecutor runs the show to include 'expungement'. Unless I know that you are not represented by counsel, I do not feel ethically permitted to answer the particulars in your question. Ask your lawyer.
