What advice are you looking for? The statute you cite is the provision regarding domestic battery. You can read this for yourself by searching 720 ILCS 5 12-3.2(a)(2). You need a lawyer, not an online Q&A forum.

It is hard to determine what advice you're seeking. The charge is for domestic battery as Atty. Goldstein explained. To add to her thoughts, this is a Class A misdemeanor unless you have a prior conviction for any number of offenses including violation of an order of protection. With such prior conviction, the charge becomes a Class 4 felony. Good luck.
