Name change issue

Bankruptcy and Debt 6 views 3 answers
My wife changed her name during her previous marriage. Now she's filing a petition for me and does not have a copy of her name change decree or previous marriage certificate. The only doc with the new name she has is the SSN. Can she file without furhter doc? OR does she necessarily need to obtain the name change decree or marriage cert?

name change is done by courts in any US jurisdiction. She can contact the court of competent jurisdiction and ask for a certified copy of the order/judgement. Marriage certificate issuance is usually an administrative task. A duplicate marriage certificate can be obtained in the same place in which she registered the marriage.

She can begin by adding your last name to hers on the I-130 petition and G-325 she is about to file, attach a copy of the marriage cert. and also seek to chance her name with DMV, etc.

Your wife will need to obtain a copy of the marriage certificate if she is still using the name from the prior marriage. She also will need to obtain a copy of the divorce decree, the latest marriage certificate and proof of your U.S. citizenship in order to file the FORM I-130.
