I have a case coming up with my Children's Mother for Contempt/Enforcement. She moved a few hours away without notifying me.

The courts were not notified either. She just up and left. I finally found her months later. I had been very involved with my children. I want them living back in the town where the children were born and there is extended family support. She has violated the court order allowing me to see them weekly. She was not allowed to move either. Would the judge make her move her or am I going to have to go this long distance to see my children?

Review Florida Statute Section 61.13001 very carefully and request that the children be returned immediately. Here is the statute: http://www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&URL=0000-0099/0061/Sections/0061.13001.html

You need to thoroughly read the Florida Relocation Statute.

If the mother has failed to comply with Florida's relocation statute, Section 61.13001, Florida Statute, you can force her to return. If the court orders her to return, and she fails to comply, you can move for the majority of the time-sharing with your children. You should seek assistance from a qualified family law attorney. Relocation issues are usually more complex than they seem at first look. Please let us know if these answers are helpful by hitting the helpful button. Good luck.

The Florida Relocation Statute is important here as she is not supposed to move that far away without a court order or a written agreement from you. You need to bring this matter before the judge and request that she move back and if she fails to comply, then you can seek additional time sharing with your children. The use of an experienced family law attorney is recommended.
