Your family will need to file for the EB5 visa before your eldest son turns 21 years of age. Hopefully, you have advanced your case sufficiently that you can present the petition before August 2015.

Generally, an unmarried child under the age of 21 at the filing of the i-526 is protected under the Child Status Protection Act. However, there are limitations to the Act and you should discuss the matter with an immigration attorney.

EB-5's are extremely complicated, require a lot of capital and administration so the VERY LEAST you should do is have an immigration attorney represent you on the EB-5. However, you need to apply with your attorney before your son turns 21. Hire an immigration attorney and NOT a paralegal, notario or business consultant illegally practicing law.

I will recommend for your son, Jhon, to do an independent EB-5 petition from your family. 3 months is too short for the in-between time of after I-526 is approved to the issuance of your immigrant visas, the chances of him aging out during this period is very great. I would consult with an attorney asap.
