Annoying Noisy Neighbor in an apartment complex: what are my rights?

Business 5 views 2 answers
Hi I live in an apartment complex and one of the neighbors run a privately-owned clothe drier every evening from 7pm to 9pm. The clothe drier is making a loud and annoying noise due to bad motor bearings. I contacted the complex management and mentioned the issue. One of the team members acknowledged the problem since she hears it too even though she lives further away from that apartment. She said she would deal with this issue. Three weeks later, the machine is as loud as ever. What are my rights? Can I pay for a repairman to fix this drier and deduct the amount from my rent? What else can I do?

Report it to your landlord. It is his/her responsibility to control tenants. If the use of the dryer is not a violation of the lease, there might not be anything you can do. The use of a dryer as you describe is probably reasonable. If it violates some sort of noise ordinance in your city, you may have a claim, but I doubt that it is that loud. You can offer to pay for the repair if you like, but you would not be able to force the repair, and would not be able to deduct the cost from your rent.

This may constitute a nuisance and/or a breach of the covenant of quiet enjoyment. You should have an attorney write a demand letter to the LL and/or the neighbor.
