How do I go about having the father of my children's parental rights terminated?

My children's father was put in prison in 2011. We were never married. I have not heard from him since early 2012. He has not paid any child support or seen/spoken to my children since 2011. My children are 7 and 4. I just received a letter from the child support office that they were closing my case because the other parent was in prison no possibility of parole until after my youngest child turned 18. His charge was child neglect causing great bodily harm. I would like to have his rights terminated but am not sure where to start.
If you were never married, then he has no rights to terminate. If the child support case was closed due to his incarceration, then there has never been a legal finding that he is the father of the child. He would have to go to court to have his rights established.

I agree with Mr. Mullaney. From your question, I am assuming that you are not married to the Father, and that DOR started the case, but did not get paternity established. If that is the case, he does not have any parental rights.

I agree with my colleagues, without a paternity order he has no parental rights to terminate. Based upon his prison sentence, it is unlikely he will ever be in your children's lives.
