Notice to Consumer Requirements

I'm a paralegal and my attorney does not know this answer either. If a subpoena is issued to a nonparty and those records are not held by a nonparty identified under 1985.3(a)(1), is a notice to consumer required. In this case copies of emails or documents being propounded on godaddy.com on one hand and on another copies of emails or documents being propounded on a former business associate whose relationship does not fall within the list under 1985.3(a)(1).

How can you be harmed by sending the Notice? At the very least, you will have notified the party whose records you seek of the subpoena. If you did not need to do that, there is no harm. If you did, then you complied with the code.

I have to tell you this is scary. All the networking available in the Los Angeles area available. All the practice guides available .... The size of the LA law library... I agree so you send the notice out what harm is done?
