Ex wife married an enlisted military officer and then he supposedly retired.

Child Support 9 views 1 answers
Can his income from being married be used for calculating child support or atty fees? They mutually benefited from the marriage by receiving housing and food allowance. Also, does anyone know if our two kids can be covered under his medical, retired or not? Why do I have to pay for double insurance? On the court motion she is only including her income and no insurance offered from her employer. Blessing to all and any who can help. Thanks.

I have changed the practice area. Because he was is the military does not change anything...if he is retired there is no housing and food allowance, it gets retirement income. .he has no legal obligation to support your children. If you are ordered to pay insurance, that is on you. I would refer you to California family Code 4057.5, it specifically excludes the new spouses income unless there are extraordinary circumstances like the her voluntarily being unemployed due to his income... I suggest you have an attorney take a look at this...
