Illegal immigrant needs help.

Hi. I'm an immigrant married to a US citizen. I have 2 US citizen children and another one on the way. I came here as a minor with my mother when I was 12. Then when I found out she never applied for any kind of residency I left and came back with a student visa. My whole life is here. I'm a french citizen but my own country is like a strange land to me. My husband won't apply for me. He was in the military when we got married and he told me it wasn't his responsibility to give me residency and that it was too complicated. What makes it worse is he is unfaithful and verbally abusive. I have nowhere to turn. I am scared to loose my children if I leave him. He says I have no rights. I understand that but is there a way for me to not loose my kids and to get away? I need help please!

Call an attorney as soon as you can.. You will likely need a family law attorney and definitely an immigration attorney. You can take control of your family life and immigration status. Don't delay.

You can pursue the violence gainst women act or VAWA. If you are successful you would get green card and then have a better standing to pursue custody should you divorce. It would be wise to consult with an experienced immigration attorney.

Please contact an Attorney, you might have a case as Battered Spouse under VAWA. You need to prove abuse and can file I-1360.

A VAWA application is your best bet. I recommend you go talk to an immigration attorney in your area.

Please consult with an experienced immigration attorney. As others have indicated, you may be eligible to apply for yourself under the Violence Against Women Act. You have mentioned some facts indicating your husband is abusive and controlling. You do not have to fear him, fear losing your children, or fear deportation. Again, consult with an attorney.

The sad thing is that it would have taken 4 months and would have been very easy for him to make you safe. Maybe the complications aren't on your side. You do have options, as the other lawyers have said. You need to have a discussion in complete confidence with a lawyer. One way to start this is to go to a local women's shelter or domestic abuse organization for advice and to ask for a referral to someone who is safe and trustworthy. Also, you say you came on a student visa. Had you given up your studies by June 2012?
