Can I be fired for chewing Nicorette?

Employment 6 views 2 answers
I work at Publix, and my boss reprimanded me for smoking outside (I'm 17 and a half). So I decided to give nicotine gum a shot. Can I be fired or disciplined for chewing gum on the job? It's against the policy, but tobacco dependence is considered an addiction. And I would think that trying to quit would be protected under the ADA? Would I be in the wrong for chewing it at work? Thanks!

I think your ADA theory is pretty weak. Because it is against the company policy unless you have a prescription you can get fired and have little recourse. Try getting a script for the patch. Good Luck.

At 17 years old do you really want to get into a dispute with your employer? Florida is an at will state so he can fire you for almost any reason. Good luck!
