Do I need an attorney for my insurance claim?
Anonymous6 views4 answers
My car was involved in a hit and run accident in early February and my insurance company (Alliance Insurance) have been giving me the run around with my claim. I have a '08 Acura TL that I've had for less than a year now. I made a report to my insurance and they sent an appraiser to my house to view the car. I was told there had to be separate appraisals for the body and mechanical damages. As soon as my car was towed to a body shop, the same appraiser never inspected my car because he recognized it from the prior appraisal. I then had my car sent to the Honda Service Center and a new appraiser was sent out. My insurance is now saying that the damages is not related to the accident but I never had any problems with my car until AFTER the accident. I am seeking an attorney immediately.
If you were not injured and required medical treatment it will be difficult to find an attorney to handle the property damage claim only. If the total is $10,000 or less, consider filing a request for arbitration to move the thing along, or even sue the company in small claims court for property damage and bad faith.

Do you have a regular mechanic you go to that can support your position that the car was fine before the accident? That may sway the insurance company to do the right thing.
Seems like you should get some advice from a mechanic. The fact that a mechanical problem shows up soon after an accident is probably not sufficient, by itself, to prove that the mechanical problem was caused by the accident. This is especially true if the insurance company already has some kind of mechanical expert who is saying the mechanical problem was probably not caused by the accident.
An estimate from a reputable mechanic, accompanied by a letter signed by the mechanic explaining how the accident most likely caused the problem, might help you get the insurance company to reverse itself.
Good luck.
