My wife and I are going through a divorce... her decision, not mine. Can my wife force me to leave the house?

My wife and I are currently going through a divorce. She has been the primary breadwinner for our entire marriage as we followed her career in the Army. (She's now out.) I took jobs where I could get them depending on where we were. I am currently unemployed and in grad school... and am the primary care taker for our 4 year old daughter. She wants to keep the house. Can she force me out before the divorce is finalized? I'm looking for a job now, but it may end up being several part-time jobs as this area is not the best for my career. Not that it's relevant. She will probably be making close to 3 times what I am once I'm employed again... There's no safety issues at all... as we are getting along well. I think it's best for my daughter... there is no fighting or raised voices...

You dont say if you have a lawyer. If you don't you need to get a confidential consultation. It is best in this matter. Even if you are amicable.

Often times the person who is the primary caretaker of any minor children will be awarded use of the marital residence while a divorce is pending. Your best bet is to find an experienced family law attorney who practices in your area to represent you throughout the proceedings. Best of luck to you!

You need to hire a lawyer to advise you on this. You'll want one familiar with dividing military retirement and child support. It sounds as though the child might be better living with you and receiving child support from the other parent. Talk to your lawyer about whether spousal support or spousal maintenance are options for you.
