My attorney served divorce from bed and board papers to my spouse on February 28 this year, we have a hearing on the 18th of this month, but have had no mediation. My husband told me yesterday that his attorney said there is someone in town who does it for free that we could see for custody on Wednesday next week, and I am wondering if I should go before the hearing or wait for the hearing and then go? I dont want my husband to get sole or full custody, due to the fact he has not been the primary care giver, and he is putting me and my daughter in alot of emotional and mental distress by living with us.

If you have an attorney, you need to ask your attorney for his/her advice. After all, he/she knows your case better than any attorney on this website. In general, it is definitely worth attempting mediation, especially if its free. It also allows you to attempt to reach agreement between the two of you, and not leave in the hands of the judge (who doesn't know anything about either one of you, or your parenting). Mediation gives you an opportunity. You will not be forced to agree. You either agree or you don't.

I agree with Attorney Haas. You should contact your attorney for their advise immediately as they know your case. Also, there is no harm in going to mediation, especially, if it is free as it is a chance for you and your ex-spouse to try and come to an agreement that would be beneficial to both of you. I strongly suggest you contact your current attorney as it appears that you have one who is handling the divorce from bed and board papers.
