What would you advise. She wants to separate during counseling

7 views 2 answers
My wife wants to separate. We have three kids in the home. I think it would be better for her to move out due to the fact that she can not pay any of the bills. plus she just got a new car that she is struggling to make the payment on. I told her the kids can stay with me in the home. of course she does not want to do that. If I move, I will have to get another place and will not be able to afford bills for two house holds.

You have many other issues that will need to be addressed (and better to address them before anyone moves out). How will you both make sure all the bills are paid? Who is going to take what property? How are you going to jointly raise your children? Within each of these questions lies many other questions... How/when to shift liability for loans, utilities, credit cards, etc.? How/when to transfer title and liability for assets? What will the custodial schedule be, and who will be responsible for what with regards to the children (who makes what decisions, health insurance, out-of-pocket costs, daycare/school, extracurricular activities, visitation parameters, holidays/vacations, etc. ). The list is vast and very much designed around your family's needs. Make and appointment with a family law attorney, to discuss all the details of your situation, and to develop a plan of action on how to proceed. Better to get some good advice, before you commit to a plan that has not been well thought-out (which takes into consideration, all the practical and legal ramifications).

I agree with Ms. Haas. You have barely scratched the surface as to teh issues involved in this case. Consult with an attorney and find out all your rights and obligations as well as options for resolving the issues. If you are both reasonable and caring you can settle without litigatiopn and at a relatively minor cost.
