Does HIPPA law protect against mental health counseling information? If so, specifically what?

Civil Rights 8 views 4 answers
My FOC order for my son, which I agreed to, says "The defendant shall attend mental health counseling". Now we are back in court and I am asking for more time with my son. Her attorney seems to think I am required to provide them with all of my counseling information. According to the research I have done, it IS information that is protected under the HIPPA law. I would rather have someone who knows the law tell me as opposed to "Google" telling me. Any advice or links to the statute and specific wording would be greatly appreciated!

Mental health services are covered under the HIPAA laws. Take a look at the link I provide. If you still have questions, I would contact a family law attorney to assist you in your parenting time complaint. http://www.hhs.gov/ocr/privacy/hipaa/understanding/special/mhguidance.html

I would suggest contacting a local attorney to help you with this situation, especially since your son's mother is represented. An attorney of your own could help you navigate these problems much better than Google.

It is concerning that you are trying to figure this out without an attorney. The specific statute that you are looking for is the MI Mental Health Code.HIPAA does also apply. I strongly recommend that you hire an attorney to assist with this very complex matter.
