I want to sue Homeaway.com for a security breach that resulted in a fraudulent transaction.

Homeaway.com is the largest online company that specializes in vacation rentals. Owners pay homeaway.com a fee to list properties for rent. I reached out to an owner on Homeaway.com for a rental property. After an agreement with the owner, and funds transferred, I found out that I was scammed. The rental listing was hacked and an impostor posing as the owner was communicating directly with potential renters. Homeaway notified me after funds were transferred that the rental listing had security concerns. At that point it was to late to reverse the transaction. I lost a total of $8500 and feel homeaway.com was negligent in protecting potential renters. I had a conversation with the true owner afterwards and he mentioned that others were also scammed.

I would need to review the agreement between you and Homeaway to give you a positive answer, but it certainly sounds to me like Homeaway is liability for violations of the Deceptive Trade Practices Act and the Fraud in Real Estate Act. Both of these statutes allow you to recover attorney's fees which will allow you to retain an attorney on a continent fee basis. You should retain an attorney who is knowledgeable in the area of consumer law, preferably one who is board certified in that area.
