If you have a warrant in Minnesota for a failure to pay a fine for no proof of insurance
Anonymous5 views5 answers
Issued a ticket in 2008 for no proof of insurance. Tried to send the proof of insurance in later on. Thought it was all over and done with. Never received a single letter or notification as to a court date, etc. I was pulled over in February and was arrested and brought in on a warrant. They did not process me in and they said that the warrant expired and it was no longer valid. I had my girlfriend drive over and gave her the money to pay. The county told her and myself that this was not a valid warrant and I didn't have to pay. So they let me go. Didn't have an issue and someone at work who ran reports for all of the company employees said that there was a warrant showing in Minnesota. I looked it up and it is for the SAME THING! HELP
This is a typical bureaucratic snafu, best handled by an experienced local lawyer who deals frequently with the specific court who issued the warrant. Until it is cleared up, such a lawyer probably get you an order vacating warrant signed by the same court who issued it, and you would be wise to carry that with you at all times, just in case you are detained again (and don't think for a minute that could not happen, until this is cleared up).

Call an attorney in your local area, or find out who the judge was that signed your bench warrant and bring this to his or her attention, and hopefully they'll do what's necessary to get it erased. If they don't, you may have a civil claim if you're unlawfully arrested once again.
This sounds like you need to go to court in the jurisdiction that issued the warrant and have the judge officially take the warrant out of the system. This may be easier to do with an attorney. Good luck.
You need the warrant lifted by the court that issued it. Either hire an attorney there or write to the court and ask. They are not interested in locking you up. If you owe money, though, they are interested in collecting the money.
Check with a lawyer in MN, but I suspect the unpaid obligation still shows in the system, as does the expired warrant. The fact that you weren't required to post cash on the warrant doesn't mean the unpaid fine isn't still out there, or that any action was taken to quash the warrant. As already noted, sounds like something a local MN lawyer could take care of easily if you can't work it out yourself. If you had insurance at the time and can prove it, you may be able to get the conviction vacated as well. Good luck.
