Emergency hearing in probate case does not get things moving. It has been five years since my mother's death!

The probate judge appointed a special administrator to take over the estate in 2013. The executor appealed and it took eleven months to hear. The appeals judge upheld the probate judge's decision but requested a letter of remand explaining the laws the probate judge used to make her decision. The letter asking for this remand was not sent for eleven months. Due to advice from this site, I asked my attorney to request an emergency hearing on the status of the case. A new probate judge (the old one retired) said she was appalled at how long the case had been delayed and promised to make sure the letter of remand was taken care of. That was two months ago. so it has been over a year since the appeal was heard. I asked my attorney to find out what is going on and got no response.

You need to hire a lawyer that does probate litigation to untangle this.

Delays occur sometimes, especially when an appeal is involved. You should contact your attorney again to check on the status of the situation.

You have already hired an attorney to handle this for you, so keep calling until you get a response from them. They know what is going on, and as was already pointed out, there are many possible reasons for the delay.
