Legal re entry after deportation ?
Anonymous3 views3 answers
My husband was deported in 2013 for assault with a deadly weapon on his papers it says he is in un able to return at all to the USA is there any chance he could return legally we have 4 year old boy and I really don't want to leave the USA because I know my son would have a better life here I would like to know if he has another chance to re enter legally with the new laws that passed for the parents that have US citizen children
Your husband's situation is very complicated and there are important facts that are missing from your question. For example: Are you a US citizen? Was your husband convicted of a felony or a misdemeanor? What was the sentence imposed? What was the sentence served? Prior to his deportation, how many times did he illegally enter the U.S.? The answers determine whether anything can be done to help your husband re-enter the country lawfully.

I assume by a "new law" you are referring to Pres. Obama's announcement of DAPA. That is not law, as it was not enacted by Congress. Moreover, it is tied up in federal court litigation so no action may be taking in reliance thereon. Your husband's crime is very serious as it involves a deadly weapon and his behavior is a danger to others. It is best for you to consult an immigration attorney for the purpose of evaluating his criminal record with the goal of possibly lowering the offense .
