Could an illegal immigrant get married in the U.S and stay during process.

Hello my boyfriend is illegal from Guatemala. Me and him are planning to get married for love and for we can travel to see his family and travel everywhere else. I've heard of pardon you would have to pay for. Would he be able to stay in the U.S during the process. He pays taxes. Or when he pays for the pardon would if they approve it. How long could it take to get papers.

Depending on his immigration and criminal histories, he can likely complete most, or all, of the immigration process inside the U.S. He may have to leave the U.S. for a short period to process his visa. Either way, the process is very complicated and mistakes have very costly penalties, so you should consult with a lawyer for assistance.

Yes it is possible for him to stay during the process. Many factors come into play, however.

He can marry and then apply for a State-side Waiver (I-601A) if he entered illegally, however, he will need to demonstrate hardship to a qualifying US citizen or Permanent Resident relative. Much more information is needed to determine whether he even qualifies to apply. If he does, the length of the process depends on the individual details of his case.

Speak to an immigration in order to determine his options. He may qualify for a waiver. A thorough consultation is needed. Good luck.
