Affidavit of support
Anonymous6 views3 answers
I was asked to fill out an affidavit of support (as a co-signer) for one of my relatives against my will deceptively. Now I found out that beneficiary, upon arrival, is planning to apply for public assistance etc.
I do understand that cost of all public assistance will be directed towards me.
I want to get out of this situation and not to be a part of this illegal activity. Please advise how do I reach out to NVC and notify them of the intentions of beneficiary and ask them not to consider affidavit of support signed by me.

I agree with my colleague - this can only be withdrawn BEFORE the person gets the immigrant visa.
You may wish to write to both the National Visa Center and consulate withdrawing the affidavit, though it's often difficult to get their attention. Include any information you have about the person's case number and/or A number, and keep a copy of your letters as well as evidence of tracking/receipt (send FedEx or certified mail).
If it can't be withdrawn before the person is/has been issued an immigrant visa in relaince on this, see the linked legal guide for when the obligation is removed otherwise.

The NVC has an inquiry email that the public can send information to - having the foreign national's identifying information when making the inquiry should be helpful. Their email address or contact page where you can directly put info into is on their website.
As for the affidavit itself - depending on what evidence you have regarding the deception and how far along the person is in the process - you might not be responsible after all. But the NVC will ultimately have to make that decision.

You can only withdraw the AOS before the immigrant visa is issued. For that, you need to inform the NVC that you are withdrawing AOS and pray the request would not fall on deaf ears. Court action is another alternative.
