Virginia Residential Lease - Move out notice (60 days) - Refused because roomates would not sign move out notice.

Greetings, I am currently in a lease with a ending date of July 31, 2015. The lease requires 60 days notice before move out. I have submitted my notice to my landlords agent via multible means (multible e-mails and a faxes). They finnaly acknowleged receiving them but said they are invalid because my roomates have not agreeed to provide a Move-Out Notice. My response to them was that the lease end of the contractual term is July 31, 2015 and it requires a 60 days notice which I have provided, and that I do not need my rooomates permission to vacate at the end of my contractually agreed term. I conceded that if the notice were not for the end of the contractually agreed term I would need their permission, but that is not the case. The landlord responded that that is the case, help!!!!

I think your best bet is to have an attorney send a similar letter -- unfortunately. I know it sounds a bit silly (and it may be), but generally, people respond differently when a letter comes from an attorney. I'm sure any attorney who replies to your question would be happy to help (myself included). Good luck.

I think your statement of the law is most likely correct (would need to see the lease to be sure). I respond in addition to my colleague out of concern as to whether your faxed and email notices are legally sufficient in Virginia. In many States, emails and text messages are not valid forms of legally notifying a landlord or tenant of anything, and a fax may or may not be as well. Only a Virginia attorney can tell you for sure in your State but do not just assume that the law recognizes modern forms of communication. I have won cases here in Oregon on that very point. So check with a local attorney before relying upon it too far.

Equity is certainly on your side; the law probably is but that's murky. Mr. Kreiger's suggestion that you get a lawyer to write confirming that you gave timely notice and will be out is a good one.
