Regarding the Colorado Statutes for modifying a parenting plan.

Does the two year waiting time to modify a parenting plan include a motion filing by the judge on the mothers behalf if this time around its the father filing?
I am afraid you will need to clarify your question. Judges do not file motions; they issue orders. If you think a judge filed a motion on behalf of the other party, then you are mistaken and do not understand what is happening in your case. You should take the paperwork you have and get in to see a family law attorney immediately, so someone can help you understand what is happening. There is no general two year "wait time" on seeking to modify a Parenting Plan; although some judges and lawyers who do not read the statute carefully seem to think there is. Section 14-10-129 of the Colorado Revised Statutes provides that if anyone files a motion seeking to change the parent with whom the child primarily resides, then no other motion seeking the same relief may be filed within two years after the prior motion is resolved, unless you can prove that the child is endangered in his/her current home.
