I'm a disabled and is 80 years old, and is receiving SSI. I had won $10,000 one lump sum from the lottery, then received half after taxes. Three years later and now Social security wants to threaten me & to say I own them money and will be axed of SSI starting in 2 months. I received my lottery and gave it to my daughters, and paid sum bills with it. why now? How can I fight it? I don't live in a fancy house and I don't drive , I am in poor health, what does Social security want from me?

As you know, SSI has income and resource limits and you were required to notify SSA of changes in income and resources. For any month that you were ineligible for SSI and yet received benefits, you are required to pay back that amount. When you gave your daughters the money, this is considered a transfer of resources. Many people transfer money to others so they can meet the resource limit. SSA is well aware of such activities and it can stop payment for people who transfer large amounts of money to others. You can appeal as well as ask for a waiver of overpayment.

You were obligated to report these winnings when you won the lottery three years. Consider filing a request for a waiver of an overpayment. SSA may or may not grant you a waiver under these circumstances. Good luck!

When you ask for a waiver, you can only enter into a repayment plan if the waiver is denied. Typically, they'll agree to 10% of your monthly benefit, but sometimes they've agreed to $10 per month. Since you're on SSI, hopefully they will allow the latter.
