Is a non debtor liable for payment of administrative fees during an adversary case that involves community assets
My Ex filed bankruptcy the day before the last scheduled trial in Family Law involving property settlement. An adversary case was brought against her since she perjured herself on the petition. The adversary case is over 3 years old. We have cooperated fully with the BK Trustee by supplying them numerous files to the properties in which they used in their Complaint. We had to file Proof of Claim and requested a Relief from Stay which the BKT filed a motion to stop us. The Judge did not grant us a relief however said that she would hear the case in the BK court regarding the properties rather than have it heard in FL. She told the BKT that they could not take my community assets to pay debts that occurred after separation . Does administrative fees come from my share of the community?
