7 views 5 answers
I did all the schooling and finished all my legal stuff. The DMV says I need to have the interlock system put on my car, how do I go about not having to do this. The DUI was in 2006 (my second) and If I have to have the interlock system in that is forcing me to buy a car along with the interlock system and I cannot afford it. Please help! :)

This DMV question needs to be answered by DMV. They maintain several nuances to the rule and regulations . It seem that if you provide proof that you do not own a motor vehicle, there would be a caveat to obtain you a license.

DMV can give you the list of approved providers. You should consult with them as to how to comply with their rules and regulations as Mr. Rouviere suggested. Good luck.

Unfortunately, if DMV says you need the interlock, you are not going to get your license until you have the interlock. It doesn't have to be in a car you own; it could be in a car you share with someone else (obviously that will be a burden on the person you share with, but it is possible). If you do not think the interlock was ordered in your case, your best bet is to consult with a lawyer (most give free initial consultation) who can get all the facts and give you advice; however, if it was your second DUI, it would have been statutorily required. Sadly, the fact that you do not own a motor vehicle is of no concern to DHSMV. There's only one exception to this rule, and that is you drive a specific vehicle at work, provided by your employers (letter carrier, UPS driver, backhoe operator). Simply put, if you want to get a license, you are required to install an IID for a one or two year period on any vehicles you regularly operate. It is a restriction on your driving to only operate a vehicle that has one installed. That means you can't rent a car, or borrow a friends car, unless it has an IID on it. maybe this is a silly questions, but why do you need a license if you don't have a car?

Unfortunately you can't avoid it. The only real exception is for medical purposes, that you are physically unable to blow into the machine. Otherwise, you must get the interlock and if you don't own a 4-wheeled vehicle, you must get one. Alternatively, you can put it on a friend or family member's car that YOU use. As an example of how harsh the DMV is, I had a client who had no one willing to put it on their vehicle, and he only owned a motorcycle for transportation, but the DMV made him buy a car to put the interlock on. He bought a car, put it on there, drove it occasionally, and after a year, he sold it.
