The other parties attorney will not confirm a date for a hearing. What are my options

I filed a motion for contempt on a parenting class, I have called the Judge's Assistant twice to get 10 or so available dates for the hearing. My ex's attorney just keeps saying she is not available and to get more dates. Clearly they are just trying to stall and play games, what are my options?

Call the JA back and explain what is happening. The judge may just schedule the hearing or the judge may decide to schedule a time where the opposing counsel will have to appear on the phone and explain why they are never available. I agree with my colleague. Another option is to have a conference call with the JA and opposing counsel. The opposing counsel may have more trouble explaining why she is not available for 10 different dates to someone who will be reporting back to the judge. Good luck.

I would call and speak with the Judicial Assistant and explain what is going on so they can give you some guidance. Believe or not, attorneys do this to attorneys also. What I have done in the past is attempted to accommodate the other attorney but when it becomes ridiculous, I have taken one of he dates the Judicial Assistant gave me and scheduled it and then placed a footnote on my Notice of Hearing " Attempted to clear with opposing counsel 15 times w/ 30 different dates". If nothing else it makes the attorney respond. Good luck. Sincerely, B. Elaine Jones, Esq.
