I'm currently looking for a bankruptcy attorney but I have a wage garnishment notification in effect. I just started a job and i'm just curious how much they are able to take from my checks? I understand when I begin the filing process it will stop but i'm trying to save for an attorney to help me. Thank you.

Michigan does not have its own statutory limits on how much can be garnished from one’s wages. Consequently, federal law governs those limits in Michigan. Under federal law, for any workweek a creditor can generally garnish the lesser of: 1) 25% of one’s disposable income, or 2) the amount by which one’s weekly disposable earnings are greater than 30 times the federal hourly minimum wage. However, there are different limits if a garnishment is for things such as child support, alimony, student loans or unpaid taxes. The U.S. Department of Labor Wage Hour Division has a fact sheet that does a good job of explaining the federal limits on wage garnishment. That fact sheet can be found at http://www.dol.gov/whd/regs/compliance/whdfs30.htm.

There are limits to the amount that they can garnish. Generally that amount is 25% but there are exceptions to that. The better answer is that there may be ways for you to stop the garnishments. Speaking to a knowledgeable attorney can help you with debts like this and with ways to avoid garnishments.
