Overstayed J1 visa for 3yrs now... ways to get back in status aside marriage
Anonymous7 views3 answers
i overstayed my visa for 3 years now. im j1 visa holder as trainee without the 2yr rule. im working in a hospitality field, and now im in training to be in a higher position. im working in quite big company. im not sure if they know my status but i never fake any documents when i applied. ( im pretty sure they knew it). i still wanna be free and get back in status. so many unexpected things happened to my family back home that triggered me to stay here.
i'm gay, belong to LGBT and so is there other way for me to stay here aside marriage?! please help me...
thank you

I agree that you should discuss this with an immigration attorney. You'll need to provide a lot of details and think through whether you could have any form of relief. It's too complex for a quick response. Some LGBT individuals have a well-founded fear that they will suffer persecution in their home country due to their sexual orientation and are eligible to apply for asylum. However, with a few exceptions, asylum needs to be applied for within the first year of arriving in the US. Work with an immigration attorney to discuss your case in detail.
Your only options (most likely) are marriage or asylum. Without more information about your home situation it is hard to tell whether you would qualify. It is imperative that you speak to an attorney and get a grasp of where you stand, because you are subject to deportation and nothing is protecting you at the moment. Also, the unauthorized employment may become an issue in the future, along with a 10 year bar for unlawful presence.
