Is fighting for majority time sharing even worth it?

Child Custody 7 views 4 answers
I'm a good mother and I have been raising my daughter on my own ever since her dad left. We were never married and I needed help supporting our child so I filed for child support and in return he filed for timesharing. At first I was like wow it took all that to finally want to be a father and I'm talking about a father that never comes and see his child. It's been 8 months into our ligitation and he only came to see our daughter 6 times for a couple of hours. The guy makes really good money and it unfortunate for me that I can't afford legal representation. He keeps saying he is a great dad but he would rather me not receive child support and take care of our daughter but have his mom take care of her. Yea he works a lot but I'm not sure it's even enough to deviate from equal timesharing

In most cases, the father will file a motion for time-sharing in response to being served with a child support petition. Why has your case been going on for so long on this matter?

I'm sorry to hear that you are going through this! It is not at all uncommon for fathers in this situation to try to get timesharing, even though their motives for doing so might be questionable. You shoulld consult an experienced family law attorney who offers free consulations to at least discuss this matter. If, as you stated, he makes good money, the attorney can ask the court to make him pay all or some of your attorney fees, so that you can have the opportunity to be on equal footing with him in court. You shouldn't have to do this alone, just because you don't earn as much as he does. I wish you well as you go through this process. I would also like to know, do you have any idea why it's taken so long for the case to resolve? Have you been to mediation yet?

Ms. Otto is correct, you need to retain an experienced family law attorney to move this case faster and to help establish what timesharing is appropriate for the father. Please let us know if this answers where at all helpful by hitting the helpful button. Good luck.

If you believe a 50/50 time sharing arrangement is not the best thing for your child, you should retain an attorney to assist you in presenting all the relevant information to the judge.
