my dad has an old DUI (2009) that he didn't fix and now he got stopped with another one. his bails bond is $3000 but he has an immigration hold since in 2002 he had an immigration court in Boston which was to far and couldn't go. he has a wife .a newborn and 2 older kids born here in the US and is a legal guardian of his niece which she don't have nobody besides him because her parents die. He was the only one working. is there any possibilities he can be out? or what can he do?
Your father seems to have an outstanding removal order. I strongly suggest that you retain an experienced immigration attorney as soon as possible. Good luck to you.

Hire a defense attorney as well as an immigration attorney ASAP. If you pay the DUI bond, he will simply be transferred to immigration custody due to the hold. It sounds like he might be subject to an in absentia order of removal due to his failure to appear in court. His case would have to be reopened.. Best of luck!
I second all of my colleagues responses. It doesn't make sense to pay the bond for the DUI, because he will be taken into ICE custody anyway. You should speak to an immigration and a criminal defense attorney as soon as possible to help navigate these two situations right away. An immigration attorney can help you explore the possibility of eventually getting him an immigration bond.
