With these basic facts, the answer is maybe. As long as there is no restraining order, no legal separation filed that prohibits it, etc., either parent can take the kids out of state. If the wife is planning on moving to the other state and not simply visiting however, and thereafter filing for divorce, keep in mind that she will have to meet residency requirements in that state to file for divorce there.
