Change in jurisdiction in CA (residence) or OR - which state to file first?

7 views 2 answers
I have full/sole custody of both boys. Received permission to move to Oregon from Sacramento, CA in summer 2014 with new husband - now its time to move. Boys' biological father has not seen/talked/attempted to see them in roughly 3.5 years...hence the permission from the courts to move. I have the form FL560 to file here in CA (I'm pro per), but do I need to do any kind of follow up in Oregon once we have arrived or file there first?

You do not state why you believe you may have to move the case to Oregon. If you are asking about enforcing a child support order, Oregon's child support enforcement department will do the work for you. If you are asking about being secure in the knowledge you were allowed to move, keep a certified copy of the California order handy. If you are asking about modifying the current custody order (and I do not know why you would with sole custody), you may have to wait until the residency requirements of the Uniform Child Custody Jurisdiction and Enforcement Act have been met. When you get to Oregon consult with an attorney who is familiar with this area of law.

While you may have permission to move to Oregon with your children, the transfer of the proceedings relating to custody, and presumably child support, is much more complicated than just filing the FL560 which is related to support only, and not applicable in your situation. In any case there is nothing you need to do at this time.
