The other attorney provided one of the best answers I have seen! I will just try to summarize here; that the utility company does not care about the lease arrangement and or who it is between, or who is living there or not living there period. Who ever has their name on the utility, will be liable regardless of any residency or lease agreements. If they fail to pay the bill, the service will be terminated and they will not be able to sign up for this utility again as well as this will effect their credit rating.

i'd imagine that's between the three girls who have either an oral or written agreement or no agreement. An equitable agreement is that the one who's living there should pay all the utilities, since she's the only one really benefitting, but you haven't explained the basic understanding or situation these girls have, What kind of an understanding did the two girls not living on the lease have with the one who was living there about ongoing responsibility for rent and utilities? Is this a temporary thing (two girls away for the summer, returning in the fall, or did the two girls on the lease just flake out, move out and leave the third on the hook for the entire rent or finding new roommates? As far as the utility companies go, they don't care, they will just pursue the one person who's name is on the bill, and if the bills aren't paid, the service will be terminated. They aren't going to care the bill should be shared and go after three people. If the service is terminated, the person who's unlucky enough to be on the bill will find it difficult to get service elsewhere without a hefty up front deposit, if at all, and may have to commit to paying off the old bill in installments.

Dear Centereach Tenant: You may wish to explain your question about a "non tenant on a lease." A tenant is a person with a rental agreement with a landlord. A lease is a form of a written rental agreement. A "non tenant" is a person without a rental agreement whether it is oral or written, with a landlord. A person may occupy a residence, a dwelling, a house, an apartment, without need of an agreement with a landlord. That person may be a family member, a guest or a roommate. If a roommate occupies a residence then the roommate has an agreement of some kind with the tenant. That agreement may be written or verbal. If written, the roommate has a relation with the tenant similar to the tenant's relation with the roommate. If the roommate agreed to pay utilities that is an agreement between the roommate and the tenant. That does not have an impact on the actual utility account, which is a contract between the utility company and a customer. The customer is the account holder and may be one of the tenants named on the lease. If one of the other tenants lives alone in the apartment or the roommate lives in the apartment along with one of the tenants, it would seem to make sense they would chip in to pay to keep the lights on even if the account holder does not live with them.
