Can I as his power of attorney sign a waiver of arraignment of my boyfriends behalf?

My boyfriend is currently incarcerated for a probation violation and is set to be released in two weeks. His violation was an MIP in a seperate county. I was told by this county to get him to sign a waiver of attainment so he doesn't have a hold. Well the county jail he is in told me he is not allowed to sign it because he doesn't have an attorney. I am his power of attorney though and have all the papers to prove it. Since he apparently can't sign it while he is in jail, am I as his power of attorney allowed to sign his waiver of arrainment for him?

No. "Power of Attorney" grants the ability to perform certain actions (sign real estate documents, set up bank accounts). It does not grant a person a license to practice law. Only licensed attorneys can appear on a person's behalf in a criminal proceeding.

I agree with Mr. Townley. The best thing to do is retain a lawyer that is familiar with the East Lansing District Court 54-B to represent him. His attorney can then file the written waiver of arraignment. and Google are great places to start your search. Look for a lawyer from the East Lansing, Lansing area that primarily practices criminal defense. Most attorneys offer free consultations so take advantage.

No. Power of attorney is different than receiving legal advice from an attorney.
