Today, my friend was in Edgewater NJ. He was smoking a cigar on private property and was approached by cops. He threw the cigar into the river as he believed the cops would mistake it for marijuana. He was then issued a citation for entering a closed area in violation of 408. 1H. He was also issued a citation under 408 1F(a) discard lit suspected marijuana cigar. My friend wants to avoid this false charge for as cheap as possible. What should he do?
An old saying goes: "you get what you pay for" If you friend wants to avoid this "false charge" tell him to get a good criminal lawyer and pay up. The better the lawyer the better your chances of winning the charge. Just so you know Edgewater is one of the tougher courts in the area so what may be easy to do in Jersey or West New York will generally be much harder if not impossible to accomplish in Edgewater. That being said what your friend is looking for is not impossible but the skill of your criminal lawyer will make all the difference.

These sound like ordinances. Depending on whether they were entered on the computer you play can this differently. My guess is the second one is not discarding a MJ cigar but only discarding something in the river. Sounds like they may have him on both. I wound need to read the ordinances they certainly are not from the 2C State criminal code. If he wants to fight use an attorney.
