Reg. H1B 2014

Hi there... I got picked in the H1B lottery 2014 and I am issued a form 221(g) (Pink sheet) requesting for more employer documentation at the stamping. My employer is not responding ever since i provided them this information. I want to check out what are the options I have now. Can I apply for H1B through another employer. If so, can you please guide me through the process

Another "employer" could petition you for H-1B and perhaps even get it approved, but you are likely to face a higher scrutiny at your local US consulate and questions on whether "there is a bona fide H-1B job offer or not", due to this "employer"'s demeanor/lack of response. A new prospective employer's immigration lawyer will know how to "guide" you through the new H-1B filing process.

I am guessing that your employer sent you the approval package and you went to the consulate outside US to get it stamped at which point you were issued the 221 (g). The U.S. Embassy or Consulate may give you a 221(g) letter directing you to submit additional documents or information related to your visa application. Your application will be kept on hold at the Embassy or Consulate until you submit those documents. So the document by itself will specify what they are looking for. without seeing the pink slip it is difficult to tell you how to move on that front. If your employer is not responding and you want to change employers you may be able to do through an H-1 Transfer, since you were subject to CAP once. Once again without full facts it is hard for me to give an answer accurately.

You cannot transfer what you don't have. Just the H-1B approval notice is not enough. USCIS is subjecting candidates to cap again - unless they get the visa stamped and start working within the fiscal year. I DO NOT AGREE WITH USCIS's opinion - but that has been the trend with most of the clients who did not successfully receive a visa. You have only a few months left to sort this. So proceed through an attorney. Please note: This is not a legal advice and does not create attorney client relationship.
