Hi, I have a protective order that was default since my ex boyfriend never showed up to court. I was told it was good for 2 years went on with my life with this piece of paper feeling more safer. anywho since It was in system that i had it i thought case automatically closed and everything was fine. Then I looked at the record yesterday and saw I was suppose to go to court a year ago for a motion to consolidate which I had NO idea about and I finished called legal aid and they told me that the case is closed I would have to re apply...what does this even mean ?! (the man is now in prison if that makes a difference)

If he is in prison, why do you need a protective order? The longest protective order lasts only 2 years from the date it is issued. Not sure what a the motion to consolidate is. After the protective order expires, the State would have to prove that there is still there is ongoing concern that there will be assaultive conduct - which they cannot do because he cannot even get to you.

Try to retain a family law counsel in Bexar County to look at the court records. My first reaction is consolidated with what? What else got dismissed? Maybe the other case is more important than the protective order. You need to get a lawyer in San Antonio area. I guess if you want Legal Aid you have to reapply for their services. You are probably safe if the man is in prison and you know when he will be up for parole. The other case that got dismissed may have been more important than the protective order if it was a parent-child suit.

Legal Aid is the only one who knows what that mean. But they seem to be saying that you need to re-apply for a protective order. Although they could be saying that you need to reapply for Legal services. Your protective order may state of the face of it when it expires. The closure of the case doesn't affect that.
